Terms of Service

These terms govern your use of this website and any consultation, membership, or program you purchase from Nina Ross Hair Therapy, LTD, doing business as Nina Ross Functional Medicine.

The agreement between us

This website is operated by Nina Ross Hair Therapy, LTD, a Georgia limited company doing business as Nina Ross Functional Medicine. Throughout these terms, we, us, and our refer to that company, and you refers to anyone using this website or purchasing our services.

By using this website, booking a consultation, or enrolling in a program, you agree to these terms. If you do not agree with them, please do not use the site or purchase our services.

We may update these terms as our services change or as the law requires. The version posted here is the one that applies, and the date at the top tells you when it last changed. Continuing to use the site after a change means you accept the updated terms.

The website is education, not medical advice

Everything published on this site, including articles, guides, videos, audio recordings, protocols, and downloadable material, exists to help you understand your own health. It is general education. It is not a diagnosis, not a treatment plan, and not a substitute for care from a qualified professional who knows your history.

Reference ranges, lab thresholds, dosages, and timelines described anywhere on this site are general and illustrative. Your own numbers have to be interpreted alongside your symptoms, your history, and your circumstances, which is what a consultation is for.

Never delay seeking care, and never start, stop, or change a prescription, supplement, or treatment because of something you read here. Talk to your own clinician first.

Using this site does not make you our patient

No clinician-patient relationship is created by visiting this site, reading our content, subscribing to anything, sending us a message, or following us on social media.

That relationship begins only after you have completed a consultation with a member of our clinical team, we have both agreed to proceed, and you have signed our intake and consent documents.

Messages sent through this website, by email, or through social media are not a way to get clinical advice, and they are not monitored around the clock. Do not send urgent medical information through those channels.

Emergencies

This website and our practice are not equipped for emergencies. If you are experiencing chest pain, difficulty breathing, severe bleeding, signs of a stroke, a severe allergic reaction, thoughts of harming yourself, or any other condition that may be life-threatening, call 911 or go to your nearest emergency department immediately.

In the United States you can reach the Suicide and Crisis Lifeline by calling or texting 988.

Consultations, memberships, and programs

Our services are membership based. A paid initial consultation is the entry point, and if we agree to work together you enroll in a program of a defined length. Program length is a clinical recommendation based on what your body needs, discussed with you before you commit.

What is included in a program is described to you in writing before enrollment. Included services may be adjusted over the course of your program based on clinical judgment, your results, and what we believe will help.

Enrollment does not guarantee any particular service, product, appointment time, or outcome. Some services are subject to availability, clinical appropriateness, and in the case of prescriptions and laboratory testing, to independent professional judgment and applicable law.

Fees, billing, and refunds

Prices are shown at the time of purchase and may change. The price you were quoted at enrollment is the price that applies to your program unless we agree otherwise in writing.

Programs may be billed as a single payment or in installments. Where you have authorized recurring payments, those charges continue on the agreed schedule until the program term ends or you cancel in line with your program agreement.

We are a private-pay practice. We do not bill insurance, and we cannot guarantee that any part of what you pay us will be reimbursed by your insurer, health savings account, or flexible spending account. On request we can provide documentation you may submit yourself.

Consultation fees, program fees, and fees for services already delivered are generally non-refundable. Specific refund and cancellation provisions for your program are set out in the agreement you sign at enrollment, and those provisions control.

Appointments, cancellations, and no-shows

Appointments are booked through our scheduling system. Please arrive or connect on time, since a late start shortens the time available and we may need to reschedule.

We ask for at least 24 hours notice to cancel or reschedule. Late cancellations and missed appointments may be charged in full, because that time was reserved for you and cannot be offered to someone else.

If we need to reschedule your appointment, we will let you know as early as we can and offer you the next available time.

Virtual care and where we can see you

We offer care in person in Atlanta and virtually. Virtual visits are conducted over video or telephone and are subject to their own consent document, which explains the benefits, the limits, and the risks of being seen remotely.

Virtual care is not appropriate for every situation. A remote visit cannot include a physical examination, and there will be circumstances where we ask you to be seen in person or refer you elsewhere.

Where you are physically located at the time of a visit can affect what services we are able to provide, because professional licensure and the practice of medicine are regulated by jurisdiction. Please tell us where you will be, and understand that some services may be unavailable, structured differently, or delivered by a different member of our team depending on your location.

Technology can fail. Dropped calls, poor connections, and platform outages happen, and we will reschedule when they do.

Laboratory testing

Laboratory testing is performed by independent third-party laboratories, not by us. Those laboratories are responsible for the accuracy of their own analysis, their handling of your specimens, and their own privacy practices.

No single result is a diagnosis. We interpret results alongside your symptoms and history, and some functional testing uses reference ranges that differ from those used in conventional settings. We will explain what a result means for you and what it does not.

Turnaround times are set by the laboratory and outside our control. Where a result requires urgent attention, we will contact you as quickly as we reasonably can.

Supplements, dispensary, and prescriptions

Statements about supplements and nutraceuticals on this site have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

Supplements we recommend or dispense are supplied by third-party manufacturers. Read labels, follow directions, and tell us about everything else you are taking, including anything prescribed by another clinician, because interactions are real.

Any prescription is written at the independent professional discretion of a licensed clinician, only where it is clinically appropriate, and only where permitted by law. Purchasing a program does not entitle you to any specific prescription.

Results, stories, and what we do not promise

We do not promise any particular outcome. Bodies differ, conditions differ, and how well a plan works depends on factors including your history, other conditions you have, and how closely the plan is followed.

Patient stories, testimonials, reviews, and before-and-after material shown on this site describe the experience of individual people. They are not typical, not average, and not a prediction of what will happen for you. Where a story has been shortened or a name changed for privacy, it is still a real account of a real person.

Timelines described anywhere on this site are general expectations rather than commitments.

What we need from you

Care depends on accurate information. By working with us you agree to give complete and truthful information about your health, your history, your medications, and your supplements, and to tell us promptly when something changes.

  • Keep your own primary care and specialty relationships in place. We work alongside them.
  • Follow the plan as written, and tell us when you cannot, so we can adjust it rather than guess.
  • Tell us about every medication and supplement you take, including anything you bought without a prescription.
  • Keep your contact details and payment information current.
  • Do not share your account access, patient portal login, or program materials with anyone else.

Acceptable use of this website

You may use this site for your own personal, non-commercial purposes. You agree not to interfere with the site, attempt to access parts of it you have not been given access to, or use it in any way that breaks the law.

  • No scraping, harvesting, or automated collection of content or data from this site.
  • No attempt to probe, scan, or test the vulnerability of our systems, and no circumventing our security.
  • No uploading of malicious code, and no interference with anyone else using the site.
  • No use of our content to train machine learning or artificial intelligence systems without our written permission.
  • No impersonation of our staff, our patients, or anyone else.

Our content and your content

The text, photography, video, audio, graphics, layout, and design on this site belong to us or to our licensors and are protected by copyright, trademark, and other laws. Nina Ross Functional Medicine and our logos are our marks.

You may read, share links to, and print reasonable portions of our content for your own personal use. You may not republish, sell, or redistribute it, or present it as your own, without our written permission.

If you send us a review, a photograph, a testimonial, or any other material, you grant us a non-exclusive, royalty-free, worldwide licence to use it in connection with our practice and our marketing, and you confirm you have the right to give us that permission. You can ask us to stop using it at any time by writing to us, and we will honour that request going forward.

Third-party services and links

This site relies on third-party services to work. Scheduling and payment are handled by outside providers, video and audio may be hosted by outside platforms, and laboratories, pharmacies, and manufacturers are independent businesses.

When you use one of those services you are also subject to their terms and their privacy practices, which we do not control. Links to other websites are provided for convenience and are not an endorsement of what appears on them.

Disclaimer of warranties

This website and its content are provided as they are and as they become available, without warranties of any kind, whether express or implied. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We work to keep the information here accurate and current, and we cannot promise it is complete, error-free, or applicable to your situation. We also cannot promise the site will always be available, secure, or free of interruption.

Limitation of liability

To the fullest extent permitted by law, neither we nor our owners, staff, or contractors will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of your use of this website or its content, including lost profits, lost data, or loss of goodwill, even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability arising out of or relating to this website and these terms is limited to the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars, whichever is greater.

Nothing in these terms limits any liability that cannot be limited under applicable law, including liability for our own gross negligence, willful misconduct, or fraud, or any liability relating to professional clinical care that applicable law does not permit us to limit. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Nina Ross Hair Therapy, LTD and its owners, staff, and contractors from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your misuse of this website, your breach of these terms, or your violation of the rights of anyone else.

Disputes and governing law

These terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules.

If a dispute arises, please contact us first. Most things can be resolved by talking, and we would rather do that than argue formally.

If we cannot resolve it, the dispute will be brought in the state or federal courts located in Fulton County, Georgia, and you and we consent to the jurisdiction of those courts.

Neither of us may bring a claim as part of a class action, consolidated action, or representative proceeding. Any claim must be brought within one year of the event it arises from, unless applicable law requires a longer period.

General provisions

If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our written consent, and we may transfer ours in connection with a sale or reorganisation of the business.

These terms, together with our Privacy Policy and any program agreement or consent document you sign, make up the whole agreement between us about the subject matter here. Where a signed program agreement conflicts with these terms, the signed agreement controls for that program.
